Foreign arbitral awards are subject to a distinct enforcement regime in Germany – shaped by the New York Convention and §§ 1061–1065 of the German Code of Civil Procedure (ZPO).

The Basic Rule

§ 1025(4) ZPO stipulates that the recognition and enforcement of foreign arbitral awards is governed by §§ 1061–1065 ZPO. This provision is declaratory in nature: it draws a clear line between the domestic and the foreign enforcement regime.

Domestic awards

Seat in Germany → equivalent to a final court judgment (§ 1055). Declaration of enforceability by the Higher Regional Court under § 1060; no substantive review on the merits.

Foreign awards

Seat abroad → enforcement under the NYC, implemented by § 1061 ZPO. Exequatur proceedings required; grounds for refusal per Art. V NYC.

The decisive criterion: the seat of arbitration

The distinction between a domestic and a foreign award depends solely on the seat of the arbitral tribunal. An award rendered abroad applying German substantive law remains a foreign award. Conversely, an award rendered in Germany applying foreign law is a domestic award.

Enforcement under the New York Convention

Parties may not invoke a simplified recognition procedure. They must undergo the exequatur proceedings under § 1061 ZPO. Jurisdiction lies with the Higher Regional Court (§ 1062(1)(4) ZPO). The available remedy against decisions is an immediate complaint (sofortige Beschwerde).

§ 1025(4) ZPO closes the regulatory circle: a coherent principle of territoriality governs from the procedural stage (subsections 1–3) through to the final stage of the award (subsection 4).

Terminology: recognition vs. enforcement

Recognition means treating the award as binding. Declaration of enforceability means giving it effect through state compulsion. For an award rendered in New York, only the conditions of the New York Convention apply in Germany.
