Notary Appointment in Berlin: Sign Well Prepared
Buying property, setting up a GmbH or transferring shares are only valid in notarial form. The notary remains neutral and does not represent your interests. That is what our law firm does: we review drafts, negotiate changes and explain to you in advance what you are signing.

For Companies and Founders
Setting Up a GmbH, UG or Holding
We draft the articles of association, clarify share capital and management and provide the notary with all the details. Some formations are also possible by video.
Transferring Shares
The sale and assignment of GmbH shares require notarisation (Section 15 (3) and (4) GmbHG). We review the purchase price, warranties and consent requirements in the articles of association.
Commercial Register: Managing Directors, Articles, Capital
New managing director, relocation of the registered office or capital increase: the filing requires a certified signature (Section 12 HGB). We prepare the resolution and the filing.
For Private Individuals and International Clients
Property Purchase and Land Charge
A property purchase agreement only becomes valid in notarial form (Section 311b BGB). We review the draft for liability exclusions, due date of the purchase price and rules on defects and negotiate on your behalf.
Powers of Attorney and Documents for Use Abroad
General, lasting or special power of attorney: we word it to suit its purpose. For foreign authorities, we arrange translation and an apostille or legalisation.
Will, Inheritance Contract and Marriage Contract
In inheritance and family law, too, the law often requires notarial form. We arrange the notarisation with a partner notary.

Frequently Asked Questions About Notaries in Berlin
Does it matter which notary I go to?
No, you are free to choose, even for property outside Berlin. The fees are set by law. Differences lie in availability, experience and languages.
How much does a notary cost in Berlin?
This depends on the GNotKG and the transaction value, such as the purchase price or share capital. Certifying a signature costs significantly less than a notarised contract. Our fee is added.
What is the difference between notarisation and certification?
In a notarisation (Beurkundung), the notary reads out the entire contract and instructs all parties, for example in a property purchase. In a certification (Beglaubigung), the notary only confirms your signature, for example for the commercial register.
Does the notary advise me or do I need a lawyer?
The notary instructs neutrally but does not negotiate for you. For your interests, liability risks and room for negotiation, you need your own lawyer.
Can I have a document notarised in English?
Yes. If the notary speaks the language, the notarisation is carried out directly in it; otherwise an interpreter translates. We organise both and explain the contract to you in advance.
Which documents do I need?
Always a valid ID card or passport. Depending on the transaction, also a register extract, list of shareholders, land register extract or tax ID. You receive a checklist from us in advance.
Do I have to appear in person to set up a GmbH?
Not always. Certain formations and register filings are now possible by video via the system of the Federal Chamber of Notaries. Granting a power of attorney is also an option.
Do you also offer online consultations?
Yes, by phone and video. This allows us to advise clients outside Berlin and abroad as well.
