According to the Federal Court of Justice (BGH), the basic rule is that conduct in violation of cartel law has an impact on the market until circumstances arise that lead to a substantial change.
However, when assessing the existence of a claim for damages, both on the merits and in terms of amount, all significant circumstances must be taken into account.
The court must comply with this requirement irrespective of the facilitation of evidence with regard to procedural findings pursuant to section 287 (1) ZPO and substantively pursuant to section 252 sentence 2 BGB in the case of lost profits.
