Abuse of the right of withdrawal




A consumer does not abuse his right of withdrawal if his primary intention is to withdraw from an economically disadvantageous contract.

If the consumer is not informed in accordance with all legal requirements, he has an unlimited right of withdrawal in individual cases, as the time limit for asserting it is then not set in motion.

Consumer law is subject to constant change, also and above all due to the need to adapt national law to the requirements of EU law.

Accordingly, different rules often apply depending on the date of the conclusion of the contract.
